Public Hearing

Chairman Marco called the public hearing to order at 7:35.

PZC2015-52 ~Application for Special Permit for Retail store selling clothing, jewelry, furniture, home accessories, consignment, and soap at 11 Phelps Way (Map 30 Lot 14 Zone DC) Owner C & S Willington CT Partnership LLC Applicant: Jane F. Copeland (Received January 19, 2016 Public Hearing by March 15, 2016 Decision within 65 days after close of P.H.)

Ms. Copeland was present.  She said her store will be called The Moon and the Monocle and will be a small gift and clothing store.  ECHN was formerly in the space she will occupy.  A. Marco looked at the application and said the sanitarian’s report stated it is approved by them.

Mr. Copeland said the hours will be 10 to 6 on weekdays and possibly until 8 PM Friday and Saturday.  

Tom Treiber, of Economic Development, said the store is a great opportunity to add another tenant to the plaza and they are in favor.  

No further comments or questions from the Commission or the public.  

D. Roberts motioned to close the public hearing.  J. Sullivan seconded the motion.  All in favor.  Motion carried.

Regular Meeting

Chairman Marco called the regular meeting to order at 7:39.  N. Martin was seated for E. Standish.

New Business

PZC2015-51 Application for Amend Special Permit & approved Site Plan for landscaping only at 327 Ruby Road (Map 42 Lot 45 Zone DC) Owner/Applicant: Royce Properties, LLC c/o George Giguere(Received January 6, 2016 Public Hearing by March 1, 2016 decision within 65 days after close of P.H.)

The public hearing has been set for March 1, 2016.

Old Business

PZC2015-47 Application for a Special Permit to construct a 100’X80’ indoor horse riding arena at 1 Potter School Road (Map 49 Lot 002-0A Zone R80) Owner/Applicant: Earl & Michelle Bancroft (Received November 17, 2015 Public Hearing on January 19, 2016 decision within 65 days after close of P.H.)

J. Sullivan motioned to approve PZC2015-47 with following conditions;

  • Use of the building shall be limited to personal use of the homeowners for their pleasure horses, no Commercial use.
  • The footprint of the new structure shall be in accordance with the plan submitted (Plan B, 100’X60’) dated 7-10-09, last revision 1-18-16, prepared by Tarbell, Heintz & Associates Inc. (7,968 sq. feet total, including existing barn).
  • Area of existing outdoor paddock/riding area (along Potter School Road). To be removed prior to use or Certificate of Occupancy of new building.
  • The architecture of the building wood frame and shall be in keeping with the style submitted at the public hearing.  Final plans to be submitted to the Commission for approval prior to building.
  • Number of horses stabled on property shall be limited to 3 total, pleasure horses, owned by homeowner.
A discussion was held on the architecture of the building.  A discussion was held on a wood or steel frame.  S. Yorgensen said a wood frame was presented at the public hearing.  The Commission agreed the wood requirement should be removed.  

A discussion was held on regulation 7.07, Accessory Uses, which limits the number of animals you can have.  Chairman Marco read the regulation and after more than three horses, additional regulations come into play, hence the restriction of 3 horses is in the motion.  

D. Roberts amended the 4th condition of the motion to read:

  • The architecture of the building shall be in keeping with the styles submitted at the public hearing.  Final plans to be submitted to the Commission for approval prior to building.
J. Sullivan seconded the amendment.  All in favor. Motion carried.

PZC2015-49 Application for a Special Permit for Antique Storage and Distribution Center
at 672 River Road (Map 47 Lot 1 Zone DI) Owner: Round Road LLC Applicant: Ann & John Zevetchin (Received November 17, 2015 Public Hearing on January 19, 2016 decision within 65 days after close of P.H.)

J. Sullivan said he listened to the previous public hearing recording.  

D. Roberts motioned to approve PZC2015-49 with the following conditions:

  • The building shall not be open to the public for retail sales.
  • No signage approved at this time, any signage shall come back before the Commission for approval.
  • Any exterior changes shall come back before the Commission for approval.
P. Nevers seconded the motion.  All in favor.  Motion carried.

  • No signage approved at this time, any signage shall come back before the Commission for approval.

P. Nevers seconded the motion.  All in favor.  Motion carried.

Staff Report

A discussion was held on a site walk for PZC2015-51.  A. Marco said the site walk is a public meeting and no discussion can be held except for clarification on information in the application.  The site walk was set for Friday, February 19th, at 4:00.  

S. Yorgensen said Loves believes they are at the point when they can apply to DEEP and get approval.  D. Roberts asked if DOT approved the plans and S. Yorgensen said no.

S. Yorgensen said Fed Ex is coming back for another modification.
